At The Godfrey Method (together with our affiliates “Godfrey Method On Demand”, ”we”, “our”, or “us”) we take your privacy seriously. We respect your privacy and are strongly committed to keeping secure any information we obtain from you or about you. This Privacy Policy describes our practices concerning Personal Information we collect from or about you when you use our website, applications, and services (collectively, “Services”). By using or accessing our Services in any manner, you acknowledge that you accept the practices and policies outlined below, and you hereby consent that we will collect, use, and share your information as described in this Privacy Policy.

 

  1. Personal Information we Collect

We collect personal information relating to you (“Personal Information”) as follows:

Personal Information You Provide: We collect Personal Information if you create an account to use our Services or communicate with us as follows:

  • Account Information: When you create an account with us, we will collect information associated with your account, including your name, contact information, account credentials, payment card information, and transaction history, (collectively, “Account Information”).
  • User Content: When you use our Services, we collect Personal Information that is included in the input, file uploads, or feedback that you provide to our Services (“Content”).
  • Communication Information: If you communicate with us, we collect your name, contact information, and the contents of any messages you send (“Communication Information”).
  • Social Media Information: We have pages on social media sites like Instagram, Facebook, Medium, Twitter, YouTube and LinkedIn. When you interact with our social media pages, we will collect Personal Information that you elect to provide to us, such as your contact details (collectively, “Social Information”). In addition, the companies that host our social media pages may provide us with aggregate information and analytics about our social media activity.

Personal Information We Receive Automatically From Your Use of the Services: When you visit, use, or interact with the Services, we receive the following information about your visit, use, or interactions (“Technical Information”):

  • Log Data: Information that your browser automatically sends when you use our Services. Log data includes your Internet Protocol address, browser type and settings, the date and time of your request, and how you interact with our website.

  • Complete Transactions: Complete the transactions you request, perform our contractual obligations, including processing payments through third-party vendors, and as otherwise anticipated within the content of our ongoing business relationship.

  • Advertising and Marketing: Send advertising or marketing communications about products, services, offers, promotions, rewards, and events offered by The Godfrey Method, Godfrey Method On Demand, and others, and provide news and information that we believe may be of interest to you.
  • Events and Offers: Offer, conduct, and administer events, classes, contests, prize draws, sweepstakes, and other promotions.
  • Research and Development: Conduct research and development.
  • Personalize Your Experience: Monitor, analyze, and audit your engagement with our brand and your interactions with our Services and online ads to better understand your interests behaviors and customer experience.
  • Safety and Security: Detect and protect against malicious, deceptive, or illegal activity, including fraudulent transactions, error, negligence, breach of contract, security incidents, and harm to the rights, property, or safety of The Godfrey Method, Godfrey Method On Demand and our users, customers, employees, or other.
  • Troubleshooting: Debug, identify, and repair errors that impair existing intended functionality of our Services.
  • Corporate Transactions:We may process Personal Information in the context of corporate acquisitions, mergers, or other corporate transactions;
  • Your Consent:We may process your Personal Information in accordance with your consent, or when you intentionally direct or instruct us to do so;
  • Comply with Legal Obligations: Comply with our legal or regulatory obligations, including our tax obligations and those related to the prevention of fraud and money laundering, and those required for you to benefit from rights recognized by law, or any regulatory requirements or provisions; and
  • Reasonable Other Purposes:As permitted by applicable law, carry out certain short-term activities and other reasonable purposes related to the products or services you purchase from us or your ongoing relationship with us. Where required by applicable law, lululemon will provide notice of such data processing prior to using your Personal Information for such purposes.
  1. Disclosure of Personal Information

We disclose Personal Information to the entities and for the purposes described below:

  • Affiliates and Subsidiaries:We disclose your Personal Information to our corporate affiliates, including our holding company, sister companies, and subsidiaries for the purposes described in the “USE OF PERSONAL INFORMATION” section above.
  • Service Providers: We disclose Personal Information to unaffiliated companies or individuals we hire or work with that perform services on our behalf, including customer support, web hosting, information technology, payment processing, financing, product fulfillment, marketing and database management, direct mail and email distribution, events, contest, sweepstakes and promotion administration, music integration, extended warranty services, and advertising and analytics services. These service providers and contractors have access to Personal Information to perform services for us.
  • Contractors and Third-Party Partners:We disclose Personal Information to unaffiliated companies or individuals we partner with to provide certain products, services, or experiences to you. For example, if you decide to pay for a purchase in installments, we disclose Personal Information to the third party that provides financing for your purchase. We also permit certain third parties, like our fraud prevention partners, to collect Personal Information to detect and prevent fraudulent transactions.
  • Corporate Transaction:Personal Information may be disclosed or transferred as part of, or during negotiations of any purchase, sale, lease, merger, amalgamation, or any other type of acquisition, disposal, securitization, or financing involving The Godfrey Method.
  • Professional Advisors:We disclose Personal Information to our legal, financial, insurance, and other advisors in connection with the kinds of corporate transactions described above or in connection with the management of all or part of The Godfrey method business or operations.
  • Law Enforcement Authorities and Individuals Involved in Legal Proceedings: We disclose Personal Information when we believe doing so is reasonably necessary to comply with applicable law or legal process (including an enforceable request from authorities), to respond to claims (including inquiries by you in connection with your purchases from lululemon), enforce or apply our TERMS OF USE, or to protect the rights, property, or personal safety of The Godfrey Method, our users, employees, or others.
  • Your Consent or at Your Direction: We disclose Personal Information, such as profile data and communications data, to third parties when we have your consent or direction to do so. For example, if you decide to participate in certain interactive areas or features of our Services, such as creating a public profile and posting your goals, you consent to the disclosure of this information to other users of our Services. We may also disclose your Personal Information to third parties, such as personal trainers, fitness studios, and providers of online booking tools, when you intentionally direct us to do so or when you use our products or services to intentionally interact with third parties.
  • Aggregated, Anonymized, or De-identified Data:We may also disclose aggregated, anonymized, or de-identified information, which cannot reasonably be used to identify you. The Godfrey Method processes, maintains, and uses this data only in a de-identified fashion and will not attempt to re-identify such data, except as permitted by law.
  • “Remember me” function:For ease of access to your account, you can use the "Remember me on this device" function when you log in to the website. This function uses technology that enables us to provide direct account access and to help administer the Godfrey Method On Demand service without requiring the reentry of any password or other user identification when your browser revisits the service. 
  • Giving others access to your account:If you share or otherwise allow others to have access to your account, they will be able to see videos you have watched, playlists, and account information (including your email address or other information in the "Account" area of our website).

 

  1. Your Privacy Rights and Choices
  • Access, Correction, Portability, and Deletion: Depending on where you reside, you may have the right to (1) request to know more about and access your Personal Information, (2) request deletion of your Personal Information, (3) request to transfer your Personal Information to a designated third-party (“data portability”) and (3) request correction of inaccurate Personal Information.   • Opting Out of Targeted Advertising, Sharing, and Sales: As described above, we process Personal Information to deliver ads targeted to your interests on other companies’ websites and mobile apps. Some of these activities may be considered “sales” or “sharing” of your Personal Information or “targeted advertising” under certain laws. In addition, we disclose your information to other entities for marketing purposes as described above, which may constitute “sales” of your Personal Information under certain laws. Depending on where you reside, you may have the right to opt out of targeted advertising, sharing, and sales of your Personal Information.
  • Nondiscrimination: We will not discriminate against you if you exercise your privacy rights.
  • Marketing Communications: You may opt out of receiving promotional communications from us by emailing us at info@thegodfreymethod.com. If you opt out, we may still send you non-promotional communications, such as those about your account or our ongoing business relations.
  • Mobile Push Notifications/Alerts: By downloading our app you agree to receive mobile push notifications. We may send promotional and non-promotional push notifications or alerts to your mobile device. You can deactivate these notifications at any time by changing the notification settings on your mobile device.
  • Cookies and Similar Tracking Technologies: Like many websites, The Godfrey Method uses cookies to analyze visits to our websites and emails and help us improve our website, services, and marketing campaigns. Most web browsers are set to accept cookies by default. If you prefer, you can usually set your browser to remove or reject cookies. Please follow your browsers’ process for doing so. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of our websites.

 

  1. California Resident Rights (California Consumer Privacy Act)

If you are a California resident, you have the rights outlined in this section. Please see the “Exercising Your Rights” section below for instructions regarding how to exercise these rights. Please note that we may process Personal Information of our customers’ end users or employees in connection with our provision of certain services to our customers. If we are processing your Personal Information as a service provider, you should contact the entity that collected your Personal Information in the first instance to address your rights concerning such data.

If there are any conflicts between this section and any other provision of this Privacy Policy and you are a California resident, the portion that is more protective of Personal Information shall control to the extent of such conflict. 5.1 Access

You have the right to request certain information about our collection and use of your Personal Information over the past 12 months. In response, we will provide you with the following information:

  • The categories of Personal Information that we have collected about you.
  • The categories of sources from which that Personal Information was collected.
  • The business or commercial purpose for collecting or selling your Personal Information.
  • The categories of third parties with whom we have shared your Personal Information.
  • The specific pieces of Personal Information that we have collected about you.

If we have disclosed your Personal Information to any third parties for a business purpose over the past 12 months, we will identify the categories of Personal Information shared with each category of third-party recipient. If we have sold your Personal Information over the past 12 months, we will identify the categories of Personal Information sold to each category of third-party recipient.

5.2 Deletion

You have the right to request that we delete the Personal Information that we have collected about you. Under the CCPA, this right is subject to certain exceptions: for example, we may need to retain your Personal Information to provide you with the Services or complete a transaction or other action you have requested. If your deletion request is subject to one of these exceptions, we may deny your deletion request. 

5.3 Exercising Your Rights

To exercise the rights described above, you or your Authorized Agent (defined below) must send us a request that (1) provides sufficient information to allow us to verify that you are the person about whom we have collected Personal Information, and (2) describes your request in sufficient detail to allow us to understand, evaluate and respond to it. Each request that meets both of these criteria will be considered a “Valid Request.” We may not respond to requests that do not meet these criteria. We will only use Personal Information provided in a Valid Request to verify your identity and complete your request. You do not need an account to submit a Valid Request.

We will work to respond to your Valid Request within 45 days of receipt. We will not charge you a fee for making a Valid Request unless your Valid Request(s) is excessive, repetitive, or manifestly unfounded. If we determine that your Valid Request warrants a fee, we will notify you of the fee and explain that decision before completing your request.

You may also authorize an agent (an “Authorized Agent”) to exercise your rights on your behalf. To do this, you must provide your Authorized Agent with written permission to exercise your rights on your behalf, and we may request a copy of this written permission from your Authorized Agent when they make a request on your behalf.

5.4 Personal Information Sales Opt-Out and Opt-In

In this section, we use the term ‘sell’ as it is defined in the CCPA. We sell your Personal Information, subject to your right to opt-out of these sales.

As described in the “Personal Information” section above, we have incorporated Cookies from certain third parties into our Services. These Cookies allow those third parties to receive information about your activity on our Services that is associated with your browser or device. Those third parties may use that data to serve you relevant ads on our Services or on other websites you visit. Under the CCPA, sharing your data through third party Cookies for online advertising may be considered a “sale” of information. You can opt out of these sales by following the instructions in this section.

Once you have submitted an opt-out request, we will not ask you to reauthorize the sale of your Personal Information for at least 12 months. 

To our knowledge, we do not sell the Personal Information of minors under 16 years of age.

5.5 We Will Not Discriminate Against You for Exercising Your Rights Under the CCPA

We will not discriminate against you for exercising your rights under the CCPA. We will not deny you our goods or services, charge you different prices or rates, or provide you with a lower quality of goods and services if you exercise your rights under the CCPA. However, we may offer different tiers of our Services as allowed by applicable data privacy laws (including the CCPA) with varying prices, rates, or levels of quality of the goods or services you receive related to the value of Personal Information that we receive from you. 

 

  1. Security

We use reasonable administrative, logical, physical, and managerial measures to safeguard your personal information against loss, theft, and unauthorized access, use, and modification. These measures are designed to provide a level of security appropriate to the risks of processing your personal information. Unfortunately, no measures can be guaranteed to provide 100% security. Accordingly, we cannot guarantee the security of your personal information. In particular, emails sent to or from us may not be secure. Therefore, you should take special care in deciding what information you send to us via the Service or email. In addition, we are not responsible for circumvention of any privacy settings or security measures contained on the Service, or third-party websites.

 

  1. Children

We do not knowingly collect or solicit Personal Information about children under 16 years of age; if you are a child under the age of 16, please do not attempt to register for or use the Services or send us any Personal Information. If we learn we have collected Personal Information from a child under 16 years of age, we will delete that information as quickly as possible. The Service may contain links to other websites not operated or controlled by The Godfrey Method, including social media services (“Third Party Sites”). The information that you share with Third Party Sites will be governed by the specific privacy policies and terms of service of the Third Party Sites and not by this Privacy Policy. By providing these links we do not imply that we endorse or have reviewed these sites. Please contact the Third Party Sites directly for information on their privacy practices and policies.

 

  1. Changes to the Privacy Policy

We are continuously trying to improve our Services, so we may need to update this Privacy Policy from time to time, but we will alert you to any such changes by placing a notice on The Godfrey Method website, by sending you an email, and/or by some other means. Please note that if you have opted not to receive legal notice emails from us (or you haven’t provided us with your email address), those legal notices will still govern for use of the Services, and you are still responsible for reading and understanding them. If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all of the changes. Use of information we collect is subject to the Privacy Policy in effect at the time such information is collected.
